These Terms of Service ("Terms") govern your use of MarginWorks, a free community operated by Wilk Industries LLC ("MarginWorks," "we," "us," or "our"). By accessing or using our community, you agree to these Terms. If you don't agree, don't use MarginWorks.

1. Acceptance of Terms

By joining our community, using our tools, or participating in our events, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy and Community Guidelines, which are incorporated herein by reference.

2. Eligibility

You must be at least 18 years old and legally able to enter into contracts to use MarginWorks. MarginWorks is intended for people starting their own businesses, but is open to anyone who follows our rules.

3. Description of Services

MarginWorks is a free community platform. We currently offer community access (hosted in a Telegram group), a free business idea quiz, and free tools and templates. We may add paid offerings in the future. If we do, they will be governed by updated terms with at least 30 days' notice.

4. Accounts and Registration

If you join our Telegram group or use any tool that requires an email address, you agree to provide accurate information. You are responsible for all activity under your account. Notify us immediately at legal@marginworks.io if you suspect unauthorized access.

5. Acceptable Use and Community Rules

By using MarginWorks, you agree to follow our Community Guidelines. The core rules are simple: be nice, and help others. Specifically, you agree not to:

  1. Harass, bully, threaten, or intimidate any member.
  2. Post content that is hateful, discriminatory, or offensive.
  3. Spam, self-promote excessively, or post irrelevant commercial content.
  4. Share illegal content, pirated materials, or copyrighted content without authorization.
  5. Impersonate another person or entity.
  6. Use MarginWorks for any unlawful purpose.
  7. Attempt to disrupt, hack, or compromise our systems or other users' accounts.
  8. Scrape, download, or redistribute community content without permission.

6. User-Generated Content

You retain ownership of any content you post in the MarginWorks community. By posting, you grant MarginWorks a worldwide, non-exclusive, royalty-free license to host, display, and distribute your content within our platform for the purpose of operating the community. You are solely responsible for your content. We reserve the right to remove any content that violates these Terms or our Community Guidelines.

7. Content Moderation

We moderate community content to maintain a healthy, helpful environment. We may warn users, remove content, restrict access, or ban users at our discretion. You can report violations by contacting us at legal@marginworks.io.

8. Suspensions and Bans

If your access is suspended or you are banned, you may appeal by emailing legal@marginworks.io with the subject line "Appeal" within 14 days. We will review appeals within 7 business days. Our decision on appeal is final.

9. Intellectual Property

All MarginWorks-branded content, templates, tools, and features are the property of Wilk Industries LLC. "MarginWorks" and the MarginWorks logo are trademarks of Wilk Industries LLC. You may not copy, redistribute, or create derivative works from our materials without written permission.

10. DMCA / Copyright Infringement

If you believe content on MarginWorks infringes your copyright, submit a DMCA takedown notice to legal@marginworks.io. Your notice must include identification of the copyrighted work, the allegedly infringing material, your contact information, a good-faith belief statement, a statement under penalty of perjury, and your electronic signature.

11. Disclaimers

MarginWorks is provided "as is" and "as available" without warranties of any kind. Content on MarginWorks is for informational and educational purposes only. It is not legal, financial, tax, or professional advice. The business idea quiz and other tools are generated using AI and may contain errors or omissions. You are responsible for verifying any information before acting on it.

12. Limitation of Liability

To the maximum extent permitted by law, Wilk Industries LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of MarginWorks.

13. Indemnification

You agree to indemnify and hold harmless Wilk Industries LLC from any claims, damages, losses, or expenses arising from your content, your violation of these Terms, or your use of MarginWorks.

14. Termination

We may suspend or terminate your access at any time, with or without cause. Upon termination, your right to use MarginWorks ends. Your community posts may remain unless you request removal in writing.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York. Before filing any claim, you agree to first contact us at legal@marginworks.io and attempt to resolve the dispute informally for at least 30 days. Any unresolved dispute will be resolved through binding arbitration in New York, New York, under the rules of the American Arbitration Association.

16. Changes to These Terms

We may update these Terms at any time. We will post the updated version with a new "Last updated" date. Continued use after changes take effect constitutes acceptance.

17. General Provisions

These Terms, along with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Wilk Industries LLC regarding MarginWorks. If any provision is found unenforceable, the remaining provisions shall remain in full force. You may not assign these Terms without our written consent.
